What can happen to Gabigol’s career?
In the trial, Gabigol will be definitively acquitted, or the two-year suspension will be upheld. The count is valid from the moment of the accusation. Therefore, Gabriel would have another year to serve, until April 2025.
The club’s management and the lawyers are optimistic about winning the case, completely removing Gabriel from the risk of being convicted.
The player is on a collision course with Flamengo and a conviction would virtually end the striker’s stint at the Rubro-Negro.
Gabigol’s anti-doping
At the end of March, Flamengo’s striker was suspended for attempted fraud in the doping control test, when the player was tested at the Ninho do Urubu, in Rio de Janeiro.
The player would have hindered the performance of the test, which is classified as fraud, and would also have hidden his genitalia when urinating in the test vessel.
Gabigol was found guilty of violating Article 122 of the Brazilian Anti-Doping Code, and received a two-year ban. The trial will still take place and has no definite date.
However, the striker’s defense managed to obtain a suspensive effect from the Anti-Doping Sports Justice Court (TJD-AD).
Defense victory
The Court of Arbitration for Sport (CAS), in Switzerland, unanimously agreed with Gabigol’s defense’s request for a suspensive effect and the striker is free to return to play for Flamengo. The panel was composed of three arbitrators – two English and one Swiss.
Suspended for two years by the Anti-Doping Sports Justice Court (TJD-AD) for attempting to fraudulently take the doping test, Gabigol was prohibited from playing and from frequenting the club’s facilities, but will return to training at the Ninho do Urubu this Tuesday (30).
Gabriel will remain free to train and play while CAS does not confirm the test. The body has not yet set a date for the final trial.
What is the suspensive effect in football?
The suspensive effect is a legal modality used by the defense of a defendant that aims to suspend the effects of a judge’s or court’s decision until the final decision on the appeal.
The strategy is widely used in Brazilian football to reduce penalties for players and clubs convicted for numerous reasons by bodies such as the Superior Court of Sports Justice (STJD).
