STJ orders Robinho’s co-convict to serve sentence in Brazil

Ministers clash on application of international sentencing as court enforces nine-year term for Ricardo Falco.

On Wednesday, the Special Court of the Superior Court of Justice (STJ) ruled that Ricardo Falco, a friend and co-convict of Robinho in a rape case in Italy, must serve his sentence in Brazil.

Minister Francisco Falcão led the majority, pushing for immediate action. He ordered that Falco’s nine-year sentence begin at once in a closed regime, stressing the gravity of the crime.

However, Minister Raul Araújo opposed this view. He argued that Brazil’s laws against extraditing its own citizens should also block such foreign sentences from being served here. “Just as you cannot extradite, we cannot execute the sentence here for a native Brazilian”, Araújo stated.

This ruling cuts into the ongoing debate over how Brazil handles serious offenses involving its citizens abroad, balancing legal precision with national policies.
